Appeals
An appeal of a lower court or administrative decision is a legal process by which a court is asked to review the lower court’s or administrative body’s decision and rule on the issues raised by the person filing the appeal, the appellant. Generally, the other parties in the case are referred to as appellees.
The Lake County Clerk’s Appeals Section prepares the record on appeal from the trial court to either the Fifth District Court of Appeals or the Florida Supreme Court depending on the type of case.
Appeals of decisions by administrative bodies are generally processed as Circuit Court cases and are handled accordingly by the Circuit Civil Section.
Florida’s Rules of Court designate the types of appeals that are permitted. The types of cases that may be appealed include:
- Appeal to Circuit Court
Decisions by administrative bodies.
- Appeal to District Court of Appeal
Trial court cases – e.g. felonies, misdemeanors, circuit civil, county civil, probate, domestic relations (family law), and juvenile cases.
- Appeal to Florida Supreme Court
Death penalty cases are appealed directly from the Circuit Court to the Florida Supreme Court by law
