Substance Abuse

The Lake County Clerk of the Circuit Court & Comptroller’s Office processes petitions for Substance Abuse treatment filed in Circuit Court.

The “Hal S. Marchman Alcohol and Other Drug Services Act of 1993,” commonly referred to as the “Marchman Act,” or “Substance Abuse Act,” allows for voluntary or involuntary assessment and stabilization of a person allegedly abusing substances like drugs or alcohol, and provides for treatment of substance abuse.

Florida Law gives the courts jurisdiction over petitions for involuntary assessments and stabilization of impaired persons.

Filing a Substance Abuse Act Petition

A Substance Abuse Act petition may be filed alleging the person needing involuntary assessment and stabilization has refused care along with other required allegations.

The Clerk’s Office staff will present any Substance Abuse Act petitions to a judge for review. The judge will determine if there is sufficient cause to enter an order directing the Lake County Sheriff’s Office to transport the person to an appropriate facility.
