The Lake County Clerk of the Circuit Court & Comptroller’s Office processes the filings in auto and other negligence lawsuits filed in the Circuit Court.
Auto Negligence
All matters arising out of a party’s alleged negligent operation of a motor vehicle.
Negligence (Other)
All actions sounding in negligence, including claims for statutory relief on account of death or injury that are not included in other main categories.
- Business governance – all matters relating to the management, administration, or control of a company.
- Business torts – all matters relating to liability for economic loss allegedly caused by interference with economic or business relationships.
- Environmental/Toxic tort – all matters relating to claims that violations of environmental regulatory provisions or exposure to a chemical caused injury or disease.
- Third-party indemnification – all matters relating to liability transferred to a third party in a financial relationship.
- Construction defect – all civil lawsuits in which damage or injury was allegedly caused by defects in the construction of a structure.
- Mass tort – all matters relating to a civil action involving numerous plaintiffs against one or more defendants.
- Negligent security – all matters involving injury to a person or property allegedly resulting from insufficient security.
- Nursing home negligence – all matters involving injury to a nursing home resident resulting from the negligence of nursing home staff or facilities.
- Premises liability – commercial – all matters involving injury to a person or property allegedly resulting from a defect on the premises of a commercial property.
- Premises liability – residential – all matters involving injury to a person or property allegedly resulting from a defect on the premises of a residential property.
Submission of Documents
The Florida Rules of General Practice and Judicial Administration require that petitions, pleadings, and documents be filed electronically except in certain circumstances. Self-represented litigants (pro se) may file petitions or other pleadings or documents electronically; however, they are not required to do so.
If you choose to file your pleadings or other documents electronically, you must do so in accordance with Florida Rule of General Practice and Judicial Administration 2.525.
If you are filing a negligence lawsuit, all documents can be submitted to the Lake County Clerk’s Office one of the following ways:
